The bail application is withdrawn, and the applicant is permitted to file a fresh application after the charge-sheet.
Summary
The applicant, Kirankumar Babubhai Patel, filed a regular bail application before the charge-sheet was filed. He later sought the court's permission to withdraw that application, stating that the charge-sheet had been filed and he wished to retain the liberty to file a fresh application thereafter. The court granted the request to withdraw the pending application, disposing of it as withdrawn without examining the merits. No substantive discussion on bail or the merits of the case was undertaken. The order simply allowed the withdrawal and preserved the applicant's right to approach the court again after the charge-sheet.
Issues considered
- Whether the applicant may withdraw a regular bail application after the charge-sheet has been filed
- Whether the court can grant liberty to file a fresh bail application after withdrawal
