The application is disposed of as not pressed.

Summary

The petitioner, Sahid @ Kannad Moyuddin Shaikh, filed a regular bail application after the filing of a chargesheet. During the hearing, the petitioner’s counsel chose not to press the application. Consequently, the High Court disposed of the application as not pressed without examining its merits. Nonetheless, the Court directed the State to ensure the petitioner receives appropriate medical treatment by transferring him to a higher medical facility in Ahmedabad and, if necessary, moving him to Sabarmati Central Jail. The trial court was also instructed to expedite the trial proceedings.

                                                    ORDER

After arguing for some time, learned advocate for the
applicant does not press this application.

Present application stands disposed of as not pressed.

It is made clear that this Court has not gone into the merits
of the matter.

However, as learned advocate for the applicant has argued
qua availability of the medical facility at Surat New Civil Hospital,
in case of urgency, the respondent-State authority is directed to
provide the best medical treatment by shifting the applicant
accused to higher center i.e. Civil Hospital, Ahmedabad and time
being shifting the applicant to the Sabarmati Central Jail,
Ahmedabad, if so necessary.

The trial court is directed to expedite the trial.
