The court held that the bail application is withdrawn and will not be considered on its merits.
Summary
The petitioner, Tirth Vinodbhai Likhiya, filed a regular bail application before the charge-sheet was filed. The respondent, the State of Gujarat, opposed the application. The court, after hearing arguments, indicated it was not inclined to entertain the bail request at this stage. Consequently, the petitioner’s counsel sought and was granted permission to withdraw the application with liberty to file a fresh one after the charge-sheet is filed. The court disposed of the present application as withdrawn without examining its merits.
