Disposal
27-WITHDRAWN @ ADM.STAGE

Holding

The Court allowed the withdrawal of the bail application and ordered the trial court to expedite the trial.

Summary

Shilpa Chotukumar Sena Kukeri (Mandal), an under‑trial prisoner, filed a regular bail application after the filing of a chargesheet. The High Court, after hearing, indicated it was not inclined to grant bail. Counsel for the applicant then sought permission to withdraw the bail application with liberty to file a fresh one after examining material witnesses, provided the trial had not progressed substantially. The Court granted this permission, disposed of the present application as withdrawn, and expressly noted that it had not examined the merits. Additionally, the Court directed the trial court to expedite the trial proceedings.

Issues considered

  • Whether the High Court should grant regular bail after the filing of a chargesheet.
  • Whether the applicant may withdraw the bail application and re‑file it later.
  • Whether the trial court should be directed to expedite the trial of an under‑trial prisoner.
