The Court permitted the withdrawal of the bail application and granted liberty to file a fresh application after the charge-sheet, without examining the merits.
Summary
Suraj Singh Chauhan applied for regular bail before the filing of a charge-sheet. During the hearing, the applicant's counsel sought permission to withdraw the bail application while reserving the right to file a fresh application after the charge-sheet is filed. The Court considered the request and, without examining the merits of the bail application, granted permission to withdraw. The application was consequently disposed of as withdrawn. The order also allowed the applicant liberty to file a new bail application post charge-sheet. No substantive discussion on the merits or legal issues was undertaken.
Issues considered
- Whether a regular bail application filed before a charge-sheet can be withdrawn with liberty to file a fresh application later
