Holding

A successive regular bail application filed without any fresh ground cannot be entertained and must be dismissed.

Summary

Jay @ Jackie Manojbhai Chauhan applied for regular bail under Section 483 of the Bhartiya Nagrik Suraksha Sanhita after a charge‑sheet was filed for offences under IPC sections 302 (murder), 363 (kidnapping) and 120B (criminal conspiracy). The applicant had already filed two earlier bail applications, which the Court had considered. In the present application, no new factual or legal ground was raised to justify another bail. The Court observed that a third successive bail application without fresh grounds cannot be entertained. Consequently, the application was rejected. The Court also directed the trial court to expedite the trial.

Issues considered

  • Whether a successive regular bail application filed after the charge‑sheet can be entertained without fresh grounds
