Holding
The Court allowed the withdrawal of the bail application, granted liberty to file a fresh application, and ordered the trial court to expedite the trial.
Summary
The applicant, an under‑trial prisoner, filed a regular bail application after the chargesheet was filed. During the hearing, the applicant's counsel sought permission to withdraw the application while reserving the right to file a fresh bail petition if the trial does not progress substantially. The Court, not inclined to examine the merits, granted the request to withdraw and allowed the liberty to file a fresh application later. The Court also directed the trial court to expedite the trial. No substantive merits of the bail claim were considered.
Issues considered
- Whether the High Court can permit withdrawal of a regular bail application after the chargesheet and grant liberty to file a fresh application.
- Whether the trial court should be directed to expedite the trial of an under‑trial prisoner.
