53-ALLOWED / GRANTED @ ADM.STAGE

Holding

The Court held that the explanation provided established sufficient cause, warranting condonation of the 183‑day delay in filing the appeal.

Summary

The State of Gujarat filed a criminal miscellaneous application seeking condonation of a 183‑day delay in filing an appeal against an acquittal order of the Additional Sessions Judge, Jetpur, Rajkot. The respondent's counsel argued that the applicant had not provided a satisfactory explanation for the delay and urged rejection of the application. The Court examined the explanation submitted by the applicant and determined that it established sufficient cause for the delay. Consequently, the Court concluded that the procedural requirement for timely filing could be relaxed in this case. The application was therefore allowed and the delay was formally condoned.

                                                   ORAL ORDER

1. The application is filed to condone the delay of 183 days
occurred in filing the criminal appeal against the judgment and order
of acquittal rendered by the learned Additional Sessions Judge, Jetpur
at Rajkot.

2. Learned counsel for the respondent has submitted that there is
no sufficient explanation rendered by the applicant to condone the

finds that the sufficient cause is made out to condone the delay.

4. In view of the above, the application is allowed. The delay is
condoned.
