CHIRANJIT UPENDRA SHARMAversusSTATE OF GUJARAT

Disposal
38-RULE ABSOLUTE/ALLOWED @ FH

Holding

Temporary bail is granted for 21 days with a personal bond and surety of Rs.25,000 each.

Summary

The accused, Chiranjeet Upendra Sharma, filed a criminal miscellaneous application seeking temporary bail for 30 days, citing the need to provide financial assistance to his family and care for his parents. The State opposed the application, but its counsel waived service of notice. The Court examined the applicant's grounds and deemed them sufficient to merit consideration. Consequently, the Court partially allowed the application, granting temporary bail for 21 days upon furnishing a personal bond of Rs.25,000 with an equal surety. The order stipulated that no extension of the bail period would be permitted and the applicant must report daily to the police station and surrender to jail authorities after the bail expires. The Court also made the rule absolute and permitted direct service of notice.
