The revisions are disposed of as not pressed and the trial court is directed to decide the suit within one year, without being influenced by its own impugned order.
Summary
In two civil revision applications (Nos. 562 and 563 of 2025), the petitioners, represented by Advocate Dev D. Patel, sought an early adjudication of the underlying suit, noting that evidence recording was already underway. The petitioner argued that the trial court should decide the suit promptly and that the revisions should not be influenced by any observations in the impugned order. The High Court accepted the submissions, disposed of both revisions as not pressed, and directed the trial court to render a decision within one year from receipt of the order, without being influenced by its own impugned order. The Court emphasized that all contentions and rights of the parties remain open. No substantive merits of the suit were addressed; the order dealt solely with case management.
Issues considered
- Whether the civil revisions should be pressed or disposed of as not pressed
- Whether the trial court should be directed to decide the suit within a specified time frame
