The Court held that the petitioner must file a fresh application with the required documents and the department must decide the application within four weeks and issue the Scheduled Caste certificate if the petitioner is entitled.
Summary
The petitioner, Bhilesha Harishkumar Umaji, filed a writ under Articles 226 and 227 of the Constitution seeking a Scheduled Caste (SC) certificate for himself and his son, alleging that the Social Welfare and Justice Department of Gujarat (Respondent No.2) refused to issue the certificate on the ground that the petitioner’s native place is in Rajasthan and that pre‑1950 evidence of SC status was required. The petitioner submitted that the Meghwal (Vankar) community is listed as a Scheduled Caste in Gujarat by a 2000 state resolution and that the City Mamlatdar had already issued a caste certificate for his son. The respondent argued that the lack of pre‑1950 documents justified the denial. The Court examined the statutory recognition of Meghwal as SC, the procedural requirement of the department, and the petitioner’s right to equality and non‑discrimination. It directed the petitioner to file a fresh application with the necessary documents within one week and ordered the department to decide the application within four weeks and issue the certificate if the petitioner is entitled, thereby disposing of the writ.
Issues considered
- Whether the Social Welfare and Justice Department can lawfully deny a Scheduled Caste certificate on the ground of lack of pre‑1950 documentary evidence.
- Whether the Meghwal (Vankar) community is entitled to Scheduled Caste status under Gujarat law and the 2000 state resolution.
- Whether the High Court can direct the department to issue the certificate or to decide a fresh application within a stipulated time.
