High Court of Gujarat

BAHADURSINH GANDUBHA CHAUHANversusSTATE OF GUJARAT

Disposal
56-DISPOSED AT ADMISSION STAGE

Holding

The petition is dismissed as no demolition has taken place and no notice was issued.

Summary

The petitioners alleged that the State authorities were proceeding to demolish premises in their possession without issuing any statutory notice. The petitioners sought relief, invoking the Supreme Court's mandate in Writ Petition (Civil) 295 of 2022 and the principles of natural justice. The respondent, represented by the I/c Mamlatdar of Chotila, appeared before the court and affirmed that no demolition action or notice had been issued. On this basis, the court found no ground to entertain the petition and ordered its disposal. The court also directed that the respondent authorities act in accordance with law and natural justice, permitting direct service of the order.

Issues considered

  • Whether demolition of the petitioners' premises was being carried out without any statutory notice.
  • Whether the petitioners are entitled to relief in the absence of any demolition action.
  • Whether the respondent authorities must comply with the Supreme Court's mandate in Writ Petition (Civil) 295 of 2022 and principles of natural justice.
