ILABA W/O RAJENDRASINH SOLANKIversusSTATE OF GUJARAT
- Disposal
- 31-NOTICE DISCHARGED @ ADM.STAGE
Holding
The petition is dismissed as the prosecution’s statement that there is no proposal to invoke the PASA Act renders the relief sought unnecessary.
Summary
Ilaba, the petitioner, filed a Special Criminal Application before the Gujarat High Court seeking relief against detention under the Prevention of Anti-Social Activities (PASA) Act. The State, represented by the Additional Public Prosecutor, informed the Court that there was no current proposal to invoke the PASA Act or to detain the petitioner. On this basis, the Court examined whether the petition remained justiciable. Finding that the relief sought had become moot, the Court held that there was no ground to entertain the application. Consequently, the petition was closed and the notice discharged.
Issues considered
- Whether a petition seeking relief against detention under the PASA Act should be entertained when the prosecution indicates no intention to invoke the Act
