Disposal
RULE ISSUED AND PARTLY ALLOWED

Holding

The court granted parole for 21 days with a Rs.25,000 bond and two sureties, refused reduction of the bond, and barred any further extensions.

Summary

The applicant, Danesh Chandra Bachchi, filed a special criminal application seeking parole leave for 30 days. The State of Gujarat opposed the application, but the respondent's counsel waived service of the rule. The High Court considered the applicant's grounds and the case circumstances, exercising its discretion in his favor. The court partially allowed the application, granting parole for 21 days upon the applicant furnishing a personal bond of Rs.25,000 with two sureties of the same amount, and imposing conditions of daily police reporting and surrender at the end of the period. The court refused any request to reduce the bond amount and ordered that no further extensions be permitted.

  • Whether the amount of personal bond and sureties can be reduced
