The court held that the police must be directed to decide and dispose of the protection application within four weeks, and the application is disposed.
Summary
The petitioners, who married on 1 May 2025, faced threats from the family of petitioner No.1 and applied to the Sehara Taluka Police Station on 4 December 2025 for police protection. The police failed to take any action on the application. The petitioners sought judicial intervention through a Special Criminal Application for direction. The High Court observed the police inaction and directed the concerned police station to decide and dispose of the protection application as expeditiously as possible, preferably within four weeks of the order. The Court further ordered that the application stands disposed, thereby concluding the proceedings.
Issues considered
- Whether the police are obligated to act on a petitioner's application for protection under a Special Criminal Application
- Whether the court can direct the police to dispose of such an application within a specified time frame
