GOVINDJI MANGAJI THAKOR THRO THAKOR VINABEN MANGAJIversusSTATE OF GUJARAT

Disposal
38-RULE ABSOLUTE/ALLOWED @ FH

Holding

Parole was granted for 21 days with a Rs.15,000 personal bond and surety, subject to reporting conditions and no extension.

Summary

The applicant, a mother appearing in person, sought parole leave for her son to attend his brother's marriage. The State, represented by counsel, waived service of the rule. The court examined the humanitarian ground and the circumstances, and exercised its discretion in favor of the applicant. It granted parole for 21 days, subject to a personal bond of Rs.15,000 with an equal surety, and required the parolee to report to the police station every alternate day and surrender after the period. The order expressly barred any extension of the parole or reduction of the bond amount. The application was therefore allowed.

Issues considered

  • Whether parole should be granted on humanitarian grounds to attend a family function
  • Whether the court can impose a personal bond and surety as conditions for parole
  • Whether the court can refuse any extension or reduction of the bond amount
