The court granted anticipatory bail to Applicant 2, subject to conditions, as no prima facie evidence linked him to the offences.
Summary
The High Court of Bombay at Aurangabad heard an anticipatory bail application filed by Sajid Majid Khan and Moin Majid Khan in connection with FIR No. 36/2026 alleging crop‑insurance fraud under the Bharatiya Nyaya Sanhita, 2023. Applicant 1 withdrew his application, and the court dismissed it as withdrawn. Applicant 2 contended that he had no role in the alleged fraud, no criminal record, and offered to submit his mobile phone to investigators. The State opposed bail, alleging that Applicant 2 assisted his brother in photographing fields for the fraudulent claim. After a prima facie review, the court found no material evidence linking Applicant 2 to the offences and ordered that, if arrested, he be released on bail upon furnishing a personal bond of Rs 15,000 with one surety, subject to standard conditions.
Issues considered
- Whether there is sufficient prima facie evidence to justify denial of anticipatory bail to Applicant 2.
- Whether the liberty of Applicant 2 should be protected in the absence of any material participation in the alleged crop‑insurance fraud.
