Bombay High Court

PRANITA SACHIN MATRE AND ANRversusSTATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The Court held that, owing to the absence of a need for custody and the existence of cross‑cases, anticipatory bail must be granted with appropriate conditions.

Summary

The High Court considered an anticipatory bail application filed by Ms. Pranita Sachin Matre and Ms. Chaya Gautam Matre seeking protection from arrest in connection with FIR No. C.R. 198/2026 filed under several sections of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed the application, but the investigating officer indicated that there were cross‑cases between the applicants and the complainant and that custody was not required. The Court examined the nature of the offences and the lack of necessity for detention, and consequently granted pre‑arrest protection on the condition of a personal bond of Rs.25,000 each with sureties. The applicants were directed to report to the investigating officer on specified dates and times. The anticipatory bail application was thereafter disposed of.

Issues considered

  • Whether anticipatory bail should be granted to the applicants in view of the FIR and the alleged cross‑cases.
  • Whether conditions such as personal bond and reporting to the investigating officer are appropriate.
