Bombay High Court

BHASKAR GANGADHR SOLASE AND OTHERSversusTHE STATE OF MAHARASHTRA

Disposal
APPLICATION ALLOWED

Holding

The court allowed the anticipatory bail application, confirming the interim protection.

Summary

The three Solase applicants sought anticipatory bail in connection with FIR No. 695/2024 alleging assault on an informant and witnesses on 6 July 2024. The FIR was lodged five months later, on 19 December 2025, raising doubts about the informant's version and the possibility of false implication. The prosecution argued that the charge sheet and injury certificates supported the allegations. The court noted the delay, the disputes between parties, and the applicants' cooperation after interim protection was granted on 4 November 2025. Finding no justification to deny bail, the court confirmed the interim relief and granted anticipatory bail with a bond of Rs. 50,000 each and standard conditions.

Issues considered

  • Whether anticipatory bail should be granted despite the seriousness of the offences under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the five‑month delay in filing the FIR creates sufficient doubt to warrant bail.
  • Whether the possibility of false implication and the applicants' cooperation affect the bail decision.

                                     DATE : 18TH AUGUST, 2026.

                 ORDER :

. Applicants seek pre-arrest bail in connection with Cr. No.
695/2024 registered with Shirdi police station Tq. Rahata, for the
                 offences punishable U/Sec. 109, 189(1), 189(2), 190, 191(1), 191(2)
and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

                 2. First information report lodged on 19 th December, 2025
indicates occurrence of incident of 06 th July, 2024 in which
                           2 949 aba 1656.25

informant and witnesses were assaulted by the applicants and
co-accused. It is claimed that in the said incident alleged serious
injuries were caused to the informant and witnesses.

3. Learned counsel for the applicants submits that first
information report came to be lodged belatedly after five months
and considering the version of the informant about intimating to
the police as well as to the doctor about the injuries being caused
serious doubt is created with regard to the version of the
informant in the first information report. It is admitted that
there are disputes between the parties and, therefore possibility
of false implication of the applicants cannot be ruled out.

4. Learned A. P. P. informs that after completion of the
investigation, charge sheet has been filed. He further opposes
the grant of any protection to the applicants by citing allegations
against them in the first information report, which according to
him are supported by the injury certificates on record.

5. Perusal of record indicates that immediately after incident
of 06th July, 2024, intimation was given to the medical officer
with regard to causing of accidental injuries. It is specifically
informed that there was vehicular accident in which they
sustained injuries. In the light of said fact, first information
report lodged after five months after occurrence of incident
creates doubt. Considering the disputes between the parties,
possibility of false implication is not ruled out. After granting

interim protection on 04 th November, 2025, applicants have
cooperated in the investigation. As such after filing of charge
sheet, this Court finds no justification not to confirm the interim
relief.

6. Hence application is allowed. I pass following order.
