RUTIK RAJARAM JADHAVversusTHE STATE OF MAHARASHTRA

Decided
Disposal
Allowed

Holding

Anticipatory bail is granted to the applicant with specified conditions.

Summary

The applicant, Rutik Rajaram Jadhav, sought anticipatory bail in connection with FIR No. 392 of 2026 alleging assault with a chopper by another accused and fist blows by the applicant during a Haldi ceremony. The FIR, filed under Sections 109, 118(1), 115(2), 352, 351(2) and 3(5) of the Bharatiya Nyay Sanhita, 2023, named the applicant as accused No.2, while the primary weapon‑related charge was against Rahul Jadhav, accused No.1. The applicant argued that the investigation was complete, a charge sheet had been filed against the other accused, the weapon recovered, and he was willing to cooperate with the investigation. The State opposed bail, citing the applicant’s alleged participation, presence at the scene, and four prior FIRs. The Court noted that the main allegations pertained to the other accused, the charge sheet was already filed, and custodial interrogation was unnecessary, directing the applicant to cooperate and attend police inquiries. Consequently, the Court granted anticipatory bail with a bond of Rs. 25,000, a surety, and conditions restricting contact with the complainant and mandating regular police station attendance.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the applicant given the nature of the allegations and his prior criminal antecedents?
  • Does the completion of investigation and filing of charge sheet against the co‑accused obviate the need for custodial interrogation of the applicant?
  • Can the applicant be released on bail subject to conditions ensuring cooperation with the investigating agency?
