PANDURANG SHANTARAM DAFALversusTHE STATE OF MAHARASHTRA

The court granted anticipatory bail to the applicant with specified conditions.
Summary
The applicant, Pandurang Shantaram Dafal, sought anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with a criminal case alleging assault, grievous hurt and other offences under the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that the applicant, a relative of the informant, attacked the informant over a land‑related dispute, causing serious injuries. The defence argued that the FIR was false, the alleged co‑accused was elsewhere at the time, and the applicant had no prior criminal record. The court noted the seriousness of the injuries but also the lack of antecedents and the fact that co‑accused had been granted bail. It therefore granted anticipatory bail, imposing strict conditions such as a cash bond, regular police reporting, furnishing contact details, and prohibitions on tampering with evidence or influencing witnesses.
Issues considered
- Whether anticipatory bail can be granted under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the offences alleged.
- Whether the nature and seriousness of the alleged offences warrant denial of bail.
- Whether imposing conditions on the grant of anticipatory bail is appropriate in the circumstances.
