Holding

Anticipatory bail was denied because the applicant was absconding as per the charge‑sheet under Section 299 of the CrPC.

Summary

Simon Ronnie Peter applied for anticipatory bail after a charge‑sheet was filed against him under Section 299 of the Code of Criminal Procedure, 1908, indicating that he was absconding. The applicant, who worked as a salesman for a developer and was alleged to have sold flats by accepting cheques and cash, was not present in court. The State, represented by Mr. S. V. Walve, argued that the applicant’s absconding status precluded any bail relief. The Court noted that the charge‑sheet itself declared the applicant as absconding, making the offence serious. Consequently, the Court found no basis to grant anticipatory bail and dismissed the application.

                                                   DATED : 17 AUGUST 2026
                       P. C. :-

                       1. None appears for the Applicant. However, with the

assistance of the learned APP appearing for the Respondent-State,

perused the papers. Learned APP states that the Applicant is

absconding and, therefore, is not entitled for grant of anticipatory

                       2. Although charge-sheet is filed, charge-sheet specifically

states that as the Applicant is absconding, the charge-sheet is filed

under Section 299 of the Code of Criminal Procedure, 1908. As

the Applicant is absconding, no case is made out for grant of

anticipatory bail.

3. As per the prosecution case, the Applicant who was working

as just a salesman with a developer and his role was only to show
