Bombay High Court
KRUSHNA @ GOTYA RAVINDRA SANAPversusSTATE OF MAHARASHTRA

The Court granted anticipatory bail to the applicant with stringent conditions.
Summary
The High Court considered an anticipatory bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by Krushna @ Gotya Ravindra Sanap, who was alleged to have participated in an assault on 4 July 2026 involving weapons offences under the Arms Act, 1959 and other statutes. The prosecution alleged a financial dispute and a group attack on the complainant, but no injury certificate was produced and the FIR was lodged after a ten‑hour delay. The applicant argued lack of injuries, willingness to cooperate, and that he would reside outside Nashik, while the State highlighted four prior antecedents and his habitual offender status. The Court examined whether the circumstances warranted bail and, finding the lack of medical evidence and the delay significant, granted anticipatory bail subject to stringent conditions, including a bond, residence restrictions, regular reporting, and non‑interference with witnesses. The order disposes of the application by granting bail with the stipulated conditions.
Issues considered
- Whether anticipatory bail should be granted to the applicant under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 despite allegations of assault and habitual offending
- Whether the absence of an injury certificate and delay in FIR registration justify bail
- What conditions, if any, should be imposed to safeguard the investigation and trial
