Bombay High Court

AJIT VIRENDRA YADAVversusSTATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The Court granted anticipatory bail to the applicant with conditions, holding that the circumstances did not warrant denial of bail.

Summary

The applicant, Ajit Virendra Yadav, filed an anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking pre‑arrest bail in connection with FIR No. 595/2025 alleging assault for not attending a marriage ceremony. The FIR alleged that the accused assaulted the informant with sticks and physical blows. The applicant had two prior criminal antecedents, and a charge‑sheet had already been filed against other accused. The Court examined whether the seriousness of the offences and the applicant’s antecedents warranted denial of bail, and concluded that the facts did not preclude anticipatory bail. Accordingly, the Court granted bail on a personal bond of Rs.30,000 with sureties, subject to standard conditions such as cooperation with investigation and non‑interference with witnesses.

Issues considered

  • Whether anticipatory bail can be granted under Section 482 of the Bharatiya Nagarik Suraksha Sanhita despite the applicant's prior criminal antecedents and the nature of the offences.
  • Whether the alleged assault and related charges justify denial of bail.

3. The prosecution case is set out in Paragraph No.2 of the

Order dated 19th August 2026 passed by the learned Sessions

Judge, Pimpri-Chinchwad, Pune, in Criminal Bail Application

No.984 of 2026, which reads as under:

“2] The First Information Report was lodged by the
informant, Suraj Yadav, alleging that the incident took
place on 11th December 2025 at around 1:30 a.m. At the
time of the incident, all the accused persons allegedly
assaulted the informant with sticks and gave kick and fist
blows, as he was not attending the marriage ceremony of
sister of Sunny Yadav. The incident was reported to the
police station. Based on his report, crime No. 595/2025
was registered. He is apprehending arrest at the hands of
        police. Hence, prayed for protection.”

4. Thus, the incident had taken place on a very small issue of

not attending the marriage ceremony of the sister of the friend of

Accused No.1.

5. Perusal of the record shows that the incident has taken place

on a very minor issue of not attending the marriage ceremony of

the sister of the friend of Accused No.1.

6. There are two criminal antecedents against the Applicant.

7. The Charge-sheet has already been filed against the other

Accused.
