SOMNATH KACHOLEversusTHE STATE OF MAHARASHTRA

Decided
Disposal
Dismissed

Holding

Anticipatory bail was denied.

Summary

Somnath Kachole applied for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with a FIR alleging that he, along with co‑accused, assaulted two persons with iron rods, wooden logs, a sickle and an iron spade on 29 May 2026, causing multiple injuries including grievous ones. The prosecution case relied on the FIR, eye‑witness testimony and the fact that the applicant was identified as the main accused. The court examined whether the seriousness of the offences and the evidentiary material justified granting bail. Finding that the FIR clearly implicated the applicant, that there were eye‑witnesses, and that the injuries were serious, the court held that no sufficient ground existed to grant anticipatory bail. Consequently, the anticipatory bail application was dismissed.

Issues considered

  • Whether anticipatory bail can be granted under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 given the seriousness of the offences and the evidence linking the applicant to the crime
