The Court allowed the withdrawal of the anticipatory bail applications and ordered continuation of interim protection until a fresh bail application is filed.
Summary
Multiple applicants had filed anticipatory bail applications in the High Court of Bombay. During the pendency of these applications, the charge‑sheet was filed against them. The applicants, on their counsel's advice, sought permission to withdraw the pending anticipatory bail applications and to file fresh bail applications before the Sessions Court. The Court, after considering the submissions of the intervenor and the applicants, allowed the withdrawal with liberty to file fresh applications and ordered that the interim protection previously granted in two of the applications be continued until the first hearing of the fresh bail applications. The applicants were directed to file the new bail applications within one week, and all pending applications were disposed of.

- Whether anticipatory bail applications may be withdrawn after a charge‑sheet has been filed
