Bombay High Court

SANJAY BHIMRAO BARAVKARversusSTATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The court disposed of the anticipatory bail application by directing the pending regular bail application to be decided within fifteen days, without expressing any view on the merits.

Summary

The applicant, Sanjay Bhimrao Baravkar, filed an anticipatory bail application alleging a medical emergency while a regular criminal bail application (No. 608 of 2026) was pending before the Additional Sessions Judge, Baramati. The respondent, State of Maharashtra, highlighted that the regular bail application was already scheduled for hearing on 5 September 2026. The court noted the overlap and, without addressing the merits of the bail request, directed the Additional Sessions Judge to dispose of the pending bail application within fifteen days. No substantive opinion on the applicant’s claim was expressed, and all parties' contentions remain open. Consequently, the anticipatory bail application was disposed of procedurally.
