Bombay High Court
DIPAK MOHAN BHAT AND ANRversusTHE STATE OF MAHARASHTRA
- Disposal
- Allowed
Holding
The anticipatory bail is confirmed and made absolute, and the application is disposed of.
Summary
The applicants, Dipak Mohan Bhat and another, sought anticipatory bail under Section 438 of the CrPC for alleged offences including rioting, robbery and assault under various IPC sections. They argued that there was an inordinate delay in lodging the FIR and that the investigation was already completed, with the charge sheet filed and the Section 307 charge dropped. The State, through its counsel, confirmed that the investigation was concluded and no custodial interrogation was required. The court noted the applicants' cooperation, the absence of any breach of bail conditions, and the principle of protecting personal liberty. Consequently, the court confirmed the earlier anticipatory bail order of 9 October 2023, making it absolute and disposing of the application.
Issues considered
- Whether anticipatory bail should be granted/confirmed despite the delay in filing the FIR
- Whether the completion of investigation and filing of charge sheet negates the need for custodial interrogation
- Whether the applicants have complied with the conditions of the earlier bail order
