The court confirmed the anticipatory bail order, making the conditions absolute, and disposed of the application.
Summary
The applicant, Nagraj R., sought anticipatory bail in connection with a case alleging sexual assault of a seven‑year‑old girl, invoking sections 354A(1)(1), 363 read with 34 of the IPC and section 8 of the POCSO Act. The trial court on 30‑Oct‑2023 granted bail subject to a personal bond and conditions, including non‑tampering with evidence and cooperation with the investigation. The applicant’s counsel submitted that he had cooperated fully, appeared before the investigating officer, and that a chargesheet had been filed and the matter was pending before the Sessions Court. The State’s counsel agreed that custodial interrogation was unnecessary and that no breach of bail conditions had occurred. The complainant’s counsel, while maintaining that the applicant was the main accused, did not dispute the filing of the chargesheet. The High Court, after considering the submissions, confirmed the anticipatory bail order and made the conditions in paragraphs 10 and 12 absolute. Consequently, the anticipatory bail application was disposed of, leaving the bail in force.
Issues considered
- Whether the anticipatory bail granted to the applicant should be confirmed and made absolute.
