Bombay High Court

NAMRATA VIJAYKUMAR KHOTversusSTATE OF MAHARASHTRA AND ANR.

Disposal

Holding

The Court granted anticipatory bail to the applicant with specified conditions.

Summary

Dr. Namrata Vijaykumar Khot applied for anticipatory bail in connection with Crime No. 363 of 2024, charged under IPC sections 406, 420, and r/w 34, and Section 3 of the Maharashtra Protection of Interest of Depositors Act, 1999. An interim bail had been granted earlier, and the applicant cooperated with the investigation, appearing before the investigating officer as required. The State opposed the application, citing the large unrecovered amount involved, while the intervenor also objected. The Court noted that a co‑accused had already been granted regular bail and found no necessity for custodial interrogation of the applicant. Consequently, the anticipatory bail was allowed, confirming the earlier interim bail conditions and adding a further condition that the applicant must continue to appear before the investigating officer as required.

Issues considered

  • Whether anticipatory bail should be granted to the applicant under the charges specified
  • Whether custodial interrogation of the applicant is necessary in view of her cooperation
  • Whether the conditions imposed are sufficient to ensure compliance with the investigation
