Bombay High Court

JAYWANT TULSHIRAM BHANDAREversusTHE STATE OF MAHARASHTRA AND ORS.

Disposal

Holding

The Court allowed the anticipatory bail application, confirming and making absolute the earlier interim order, subject to additional conditions.

Summary

Jaywant Tulshiram Bhandare, a 75‑year‑old senior citizen, applied for anticipatory bail under sections 351(2), 339, 338 and 331(1) of the Bharatiya Nyaya Sanhita, 2023 in a case registered on 9 January 2026. He claimed false implication, asserted that there was nothing to be recovered, and demonstrated cooperation with the investigating officer, having already obtained interim protection from the Sessions Judge. The High Court initially granted interim bail subject to conditions, later extending time for compliance with procedural orders concerning spare copies of the paper‑book. After several adjournments and the non‑appearance of one respondent, the Court examined the applicant’s cooperation, the filing of a charge sheet, and the lack of any flight risk. The Court confirmed the earlier interim order, made it absolute, and imposed additional conditions regarding regular appearances before the investigating officer and furnishing of address details. Consequently, the anticipatory bail application was allowed with the stipulated conditions. The order was disposed of on 11 September 2026.

Issues considered

  • What is the appropriate exercise of discretion by the Court in granting anticipatory bail under the Bharatiya Nyaya Sanhita?
  • Whether the applicant, being a senior citizen and allegedly falsely implicated, satisfies the criteria for anticipatory bail.
  • Whether procedural defaults (failure to furnish spare copies of the paper‑book) justify dismissal of the application.
  • Whether the filing of a charge sheet and the applicant’s cooperation affect the necessity of custodial interrogation.
