ABHISHEKH ALIAS ABHI AMBADAS MANTRIversusTHE STATE OF MAHARASHTRA AND ANR.

Holding

The court confirmed the anticipatory bail order with the added conditions and disposed of the application.

Summary

The applicant, Abhishekh Mantri, sought anticipatory bail in connection with Crime No. 131 of 2026, which involved offences under the Bharatiya Nyaya Sanhita, 2023, the Arms Act, 1959 and the Maharashtra Police Act, 1951. The trial court had earlier granted interim bail on the condition that the applicant cooperate with the investigation and comply with certain restrictions. Both parties appeared before the court, acknowledging the applicant's cooperation and the recovery of the weapon, while the State requested an additional restriction preventing the applicant from entering the jurisdiction of Ichalkaranji Police Station until charge framing. The applicant consented to the same restriction. The court confirmed the earlier bail order, added the two conditions—mandatory appearance before the investigating officer as required and prohibition from entering the jurisdiction until charge framing—and disposed of the anticipatory bail application.

Issues considered

  • Whether anticipatory bail should be granted to the applicant in view of the nature of the offences and his cooperation with the investigation
  • Whether the court may impose an additional condition prohibiting the applicant from entering the jurisdiction of the investigating police station until the charge is framed
