The Court allowed the withdrawal of the anticipatory bail application with liberty to file a fresh application, and ordered that the earlier protective order remain effective for one week.

Summary

The applicant filed an anticipatory bail application before the High Court of Bombay, which was opposed by the State on the ground that the applicant had seven undisclosed criminal antecedents. The State counsel highlighted these antecedents from the police report. In response, the applicant's counsel sought to withdraw the existing anticipatory bail application and obtain permission to file a fresh one. The Court, after considering the submission, allowed the withdrawal of the anticipatory bail application with liberty to file a new application. Additionally, the protective order dated 12 February 2026 was directed to remain in force for one week.

Issues considered

  • Whether the anticipatory bail application can be withdrawn and a fresh application filed in view of undisclosed criminal antecedents.
  • Whether the protective order previously granted should continue to operate pending a fresh application.

Subjects

  • anticipatory bail
  • withdrawal
  • criminal antecedents
  • protective order
