SARFRAJ SHARIF TAMBOLIversusTHE STATE OF MAHARASHTRA

The Court granted anticipatory bail to the applicant, subject to specified conditions.

Summary

The applicant, Sarfraz Sharif Tamboli, filed an anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, fearing arrest in Crime No. 0366 of 2026 for alleged possession of Gutkha, a banned item in Maharashtra. The charges include offences under Sections 223, 274, 275, 123 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and several provisions of the Food Safety & Standards Act, 2006. The principal issue is whether Section 123 of the BNS, which deals with causing hurt by poison, can be invoked for possession of banned Gutkha, a question currently pending before the Supreme Court (Anand Ramdhani Chaurasia v. State of Maharashtra). The High Court, noting the pending Supreme Court reference and the applicant’s cooperation with the investigation, granted both anticipatory and regular bail subject to strict conditions. The bail order requires a personal bond of Rs 100,000, regular reporting to the investigating officer, and prohibitions against tampering with evidence, influencing witnesses, or committing similar offences.

Issues considered

  • Whether Section 123 of the Bharatiya Nyaya Sanhita, 2023 can be applied to the alleged possession of banned Gutkha/pan masala.
  • Whether anticipatory bail can be granted under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in the present circumstances.
