VISHAL BASAPPA AATHAWALEversusTHE STATE OF MAHARASHTRA AND ANR.

The court allowed the anticipatory bail application, finding no prima facie material linking the applicant to the offence and noting his existing interim bail.
Summary
Vishal Basappa Aathawale applied for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, fearing arrest in Crime No. 268 of 2026, which alleged offences under Sections 118(1), 351(2), 352 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. The FIR originally named three unknown assailants; the applicant was later added as Accused No. 4 based solely on the informant’s later statement that the assault was on the applicant’s instructions. The applicant contended he was not named in the FIR, had no material linking him to the crime, and was already on interim bail from the Sessions Court without any breach. The court found no prima facie evidence against the applicant, noted his existing bail, and held that custodial interrogation was unnecessary. Consequently, the court granted anticipatory bail with standard conditions, including furnishing a bond and cooperating with the investigation.
Issues considered
- Whether anticipatory bail can be granted under Section 482 when the applicant is not named in the FIR and no prima facie material links him to the alleged offences.
- Whether the existence of an interim bail order precludes the necessity of custodial interrogation.
- Whether the conditions imposed are appropriate for the grant of anticipatory bail.
