SUGANDHA SHANKAR BHOSALEversusTHE STATE OF MAHARASHTRA AND ANR

Disposal
Disposed off as Withdrawn

Holding

The court granted leave to withdraw the anticipatory bail application and disposed of it as withdrawn.

Summary

The applicant, Sugandha Shankar Bhosale, filed an anticipatory bail application seeking release on bail for alleged offences under IPC Sections 419, 420, 465, 467, 468, 471 read with Section 34 and corresponding provisions of the Bombay Narcotic Substances Act, 2023. The applicant’s counsel, Mr. Abhishek Patil, later sought leave of the court to withdraw the application. The State’s counsel did not oppose the request. The court considered whether the applicant could be permitted to withdraw the anticipatory bail application at the interlocutory stage. Finding no objection and noting the applicant’s clear intention, the court granted leave to withdraw. Consequently, the anticipatory bail application was disposed of as withdrawn.

Issues considered

  • Whether an anticipatory bail application may be withdrawn at the interlocutory stage upon the applicant’s request
