PAWAN MANIK MANEversusTHE STATE OF MAHARASHTRA AND ANR

Disposal
Disposed off as Withdrawn

Holding

Anticipatory bail is granted subject to the condition that the applicant shall appear before the investigating officer as and when required.

Summary

The applicant, Pawan Manik Mane, filed an anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking protection from arrest in connection with offences under various sections of the Bharatiya Nyaya Sanhita, 2023 and the Arms Act, 1959. He had earlier been granted protection from arrest in a separate bail application and had cooperated with the investigating officer. The State, through the investigating officer, agreed that custodial interrogation was unnecessary but insisted that the applicant continue to appear before the officer as required. The Court considered the cooperation shown by the applicant and the State’s request, and disposed of the anticipatory bail application by granting bail subject to the condition that the applicant appear before the investigating officer whenever required. The order thus grants anticipatory bail with a single condition and closes the application.

Issues considered

  • Whether anticipatory bail should be granted to the applicant under Section 482 of the B.N.S.S., 2023 in view of his cooperation with the investigation.
  • Whether imposing a condition that the applicant appear before the investigating officer as and when required is appropriate.
