The appeal was dismissed, with the High Court directing the trial court to expedite the suit and continuing the stay order without expressing any view on the merits.
Summary
The appellant filed an appeal under Order XLIII Rule 1(r) read with Section 104 of the CPC against the City Civil Court's order dated 2 December 2021, which had rejected his ad‑interim relief and a prior motion while granting a two‑week interim protection. The High Court noted that the underlying suit was already at the stage of recording evidence and that the trial court should complete the trial expeditiously, preferably within nine months, without granting further adjournments. The Court clarified that it was not expressing any view on the merits of the suit and that the trial court must decide the case independently in accordance with law. It also ordered that the stay granted on the notice/order dated 21 January 2012 continue until the final disposal of the suit. Consequently, the appeal was disposed without any costs, and any interim applications were also dismissed.
Issues considered
- Whether the appellate court should interfere with the trial court's rejection of interim relief.
- Whether the trial court should be directed to expedite the pending suit and limit adjournments.
- Whether the stay order dated 21 January 2012 should continue until final disposal of the suit.

decide the pending suit as expeditiously as possible and preferably within a period
of nine months from the date of uploading of this order.
3. The parties shall not seek adjournments at the trial of the suit. All
contentions of the parties are expressly kept open.
4. Needless to clarify that this Court has not expressed any opinion or
given any finding in respect of challenge in the present Appeal from Order and the
Trial Court shall dispose of the suit independently and in accordance of law.
5. Appeal from Order is disposed of in the aforesaid terms. No costs.
Interim Application, if any, also stands disposed of.
