The appellate court disposed of the appeal without deciding the merits, ordering the notice of motion to be heard expeditiously and the status‑quo to be maintained pending that hearing.
Summary
The appellants filed an appeal under Order XLIII Rule 1(r) of the CPC and Section 104 of the CPC challenging the trial court's refusal to grant ad‑interim relief against a demolition notice issued under Section 354(A) of the Mumbai Municipal Corporation Act, 1888. The respondents showed that demolition of the suit structure had already begun and submitted photographic evidence. The High Court, without addressing the merits, directed that the pending notice of motion be heard on 2 December 2026 with no adjournments and that the status‑quo be maintained until that hearing. The court emphasized that all contentions remain open for the trial court and disposed of the appeal without costs. No substantive decision on the merits was made.
Issues considered
- Whether the trial court erred in rejecting the ad‑interim relief sought under Section 354(A) of the Mumbai Municipal Corporation Act.
- Whether the status‑quo should be maintained pending the hearing of the notice of motion.
