The proceedings are to be transferred to the Sessions Court having jurisdiction.
Summary
Avinash Balkrishna Paranjape appealed against Mandar Ashok Chaphekar and others, but neither the appellant nor his counsel appeared before the Bombay High Court. The State, represented by Dr. A. A. Takalkar, relied on the Supreme Court judgment in Celestium Financial Ltd. v. A. Gnanasekaran (2025) to argue that the matter should be heard by the Sessions Court having territorial jurisdiction. The High Court agreed and ordered the transfer of the proceedings to the appropriate Sessions Court, directing the registrar to effect the transfer and the Sessions Court to re‑register the case, issue notices, and expedite the trial. The court also directed the parties to cooperate for early disposal. Consequently, Criminal Appeal No. 1032 of 2018 and any interim applications were disposed of.
Issues considered
- Whether the High Court has jurisdiction to continue the criminal proceedings or should transfer them to the Sessions Court having territorial jurisdiction
