The proceedings are transferred to the Sessions Court having jurisdiction.
Summary
The appellant, Sangli District Mahila Vikas Co. Operative Credit Society, appealed against Alka Rajaram Mane and others. The learned counsel for both sides cited the Supreme Court decision in Celestium Financial v. A. Gnanasekaran (2025) to argue that the matter should be before a Sessions Court with appropriate jurisdiction. The High Court, after considering the submissions, ordered that the proceedings be transferred to the competent Sessions Court, directing the registrar to effect the transfer and the Sessions Court to re‑register, issue notices and expedite the case. The Court also directed cooperation of parties for early disposal. The appeal and any interim applications were thereafter disposed.
