The appeal is allowed and anticipatory bail is granted to the appellant.

Summary

The appellant, Anil Dattatraya Jadhav, sought anticipatory bail in a case registered as Crime No. 499 of 2025 for offences under Section 69 of the Bharatiya Nyaya Sanhita, 2023 and Sections 3(1)(w)(i)(ii) and 3(2)(v) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The prosecution alleged that the appellant had sexual intercourse with the victim by falsely promising marriage. Both the appellant and the victim later settled the dispute and filed a petition to quash the FIR by mutual consent. The Special Court had rejected the anticipatory bail application, prompting the appellant to appeal under Section 14‑A of the SC & ST Act. The High Court, after considering the settlement and the overall circumstances, allowed the appeal, set aside the lower court’s order, and granted anticipatory bail subject to a personal bond of Rs.25,000 with sureties. The appeal was disposed accordingly.

Issues considered

  • Whether anticipatory bail should be granted to the appellant despite the seriousness of the offences under the Bharatiya Nyaya Sanhita and the SC & ST Act
  • Whether the settlement between the appellant and the victim and the petition to quash the FIR affect the grant of anticipatory bail
