The High Court ordered that the criminal appeal be transferred to the Sessions Court having jurisdiction.
Summary
The appellant, Dharmveer Sambhaji Sahakari Patsanstha, filed a criminal appeal (No. 1273 of 2018) before the Bombay High Court, Circuit Bench at Kolhapur, against respondent Someshwar Dyaneshwar Dhone. Neither the appellant nor its counsel appeared before the court. The respondent's counsel, S. H. Yadav, relied on the Supreme Court decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the matter should be heard by the Sessions Court having territorial jurisdiction. The High Court agreed and ordered the transfer of the proceedings to the appropriate Sessions Court, directing the registrar to effect the transfer and the Sessions Court to re‑register, issue notices, and expedite the case. Consequently, the appeal and any interim applications were disposed of.
