The appeal is transferred to the Sessions Court, Sangli, as the appropriate forum for adjudication.

Summary

The appellant, Shirish Shripatrao Mohite, filed a criminal appeal (No. 1305 of 2006) that had been pending before the Bombay High Court since 2006. The appellant's counsel argued that, following the Supreme Court's decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320), the appeal should be heard by a Sessions Court. The learned High Court judge examined the Supreme Court precedent and agreed that the jurisdiction lay with the Sessions Court. Consequently, an order was issued transferring the appeal to the Sessions Court in Sangli and directing the registrar to effect the transfer. The judge also instructed the Sessions Court to expedite disposal of the long‑pending matter.
