The proceedings are to be transferred to the Sessions Court having jurisdiction.

Summary

In Criminal Appeal No. 132 of 2023, the appellant Baburao Ramchandra Patil sought transfer of the pending proceedings to a Sessions Court having jurisdiction, relying on the Supreme Court’s decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320). The respondent State, through its counsel, did not oppose the transfer. The High Court, after hearing both sides, ordered that the proceedings be transferred to the appropriate Sessions Court, directing the Registrar to effect the transfer and the Sessions Court to re‑register the case, issue notices, and expedite the matter. The Court also directed the parties to cooperate for early disposal. Consequently, the appeal and any interim applications were disposed of.
