Bombay High Court
NARENDRA MANIK BHOSALEversusUDDHAV MURALIDHAR CHAVAN AND ANR
- Disposal
- Disposed Off
Holding
The appeal is transferred to the Sessions Court having jurisdiction.
Summary
The appellant, Narendra Manik Bhosale, was absent along with his counsel when the appeal was called. The State’s counsel, Dr. A. A. Takalkar, relied on the Supreme Court’s decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the matter should be before a Sessions Court having jurisdiction. The High Court agreed that the appeal should be transferred to the appropriate Sessions Court. It directed the Registrar to effect the transfer, ordered the Sessions Court to re‑register the case, issue notices, and expedite the proceedings. Consequently, the criminal appeal No. 1508 of 2011 and any interim applications were disposed of.
