Holding
The appeal is transferred to the Sessions Court having jurisdiction, and the High Court proceedings are disposed of.
Summary
The appellant, Parth Shrikrishna Gore, was absent when the matter was called. The State's counsel, Ms. Mahalakshmi Ganapathy, relied on the Supreme Court’s decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the case should be heard by the Sessions Court having jurisdiction. The High Court agreed and ordered the transfer of the proceedings to the appropriate Sessions Court, directing the registrar to effect the transfer and the Sessions Court to re‑register, issue notices, and expedite the matter. The Court also directed the parties to cooperate for early disposal. Consequently, Criminal Appeal No. 1555 of 2019 and any interim applications were disposed of.
Issues considered
