The proceedings are transferred to the Sessions Court having jurisdiction.

Summary

The appellant, Vilas Maruti Shendage, filed a criminal appeal seeking that the proceedings be transferred to a Sessions Court having jurisdiction, relying on a recent Supreme Court decision. The respondent State opposed the transfer. The High Court, after hearing counsel, noted that the Supreme Court precedent indicated that such matters should be dealt with by the appropriate Sessions Court. Consequently, the Court ordered the transfer of the proceedings, directing the Registrar to effect the transfer and the Sessions Court to re‑register, issue notices, and expedite the case. The appeal and any interim applications were thereafter disposed.
