Bombay High Court

RAVINDRA DATTATRAY TULPULEversusTHE STATE OF MAHARASHTRA AND ANR

Disposal
Disposed Off

Holding

The High Court ordered that the proceedings be transferred to the Sessions Court having jurisdiction.

Summary

The appellant, Ravindra Dattatray Tulpule, did not appear before the Bombay High Court, either in person or via video conference. The State of Maharashtra, through counsel C. D. Mali, relied on the Supreme Court’s decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the matter should be before a Sessions Court with appropriate jurisdiction. The High Court accepted this submission and ordered that the criminal appeal be transferred to the competent Sessions Court. It directed the Registrar to effect the transfer, instructed the Sessions Court to re‑register the case, issue notices, and proceed on the merits, while also urging an expedited disposal. Consequently, Criminal Appeal No. 1611 of 2011 and any interim applications were disposed.
