The appeal is allowed and the appellant is released on bail with specified conditions.
Summary
Ahmed Raza, an 18‑year‑old, was charged under the Bharatiya Nyaya Sanhita, the Protection of Children from Sexual Offences Act and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for allegedly expressing love and following a 14‑year‑old girl. The trial court denied his regular bail. On appeal under Section 14A of the SC/ST Act, the High Court noted that the investigation was complete, no physical assault was alleged, and the prosecution had not shown a need to keep the appellant in custody. Consequently, the court allowed the appeal and granted bail on a personal bond of Rs.10,000 with sureties, imposing conditions such as non‑contact with the victim, furnishing address details, and not tampering with evidence. The Legal Services Committee was directed to pay legal fees to the appointed legal‑aid counsel for the victim. The appeal was disposed with bail granted.
